These Terms of Use ("Terms") govern your use of prominentcashoffer.com, the AI concierge, property lookups, offer and call requests, and your Prominent account (the "Services"), provided by Prominent Cash Offer, LLC, a Delaware limited liability company ("Prominent," "we," "us"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. What Prominent does
Prominent buys residential and other real estate directly from owners, generally for cash and as-is. We are the buyer. We are not a real estate broker or agent, we don't list properties, and we don't represent you or act on your behalf in a sale. You're welcome to talk to a real estate agent, attorney, tax adviser or anyone you trust before you decide anything, and we encourage you to.
2. Estimates, offers and no obligation
Property profiles, comparable sales, estimates and ranges shown on the Services are preliminary, non-binding and based on the information available at the time. They are not appraisals, not offers and not commitments to buy. An offer exists only when we give you one in writing, and a sale happens only under a written purchase agreement signed by you and us. Asking for an offer or a call never obliges you to sell, and you're free to decline any offer.
3. How a sale works
Each purchase is governed by its own written purchase agreement, which controls if it differs from anything on the Services. Closings take place through a title company, escrow company or closing attorney. Prominent may assign its rights under a purchase agreement to another buyer, or buy the property and resell it, including at the same closing (a double close), where the law allows. If we assign, the purchase agreement will say so, and the price and terms you agreed to stay the same. Any disclosure that state law requires will be in the purchase agreement or closing documents.
4. Property information
Property information comes from public records, map and data providers and what you tell us. It may be incomplete, out of date or wrong, and it doesn't establish who owns a property or has authority to sell it. Don't rely on it as a survey, appraisal, inspection or title report. You can send us corrections, which we keep with your request.
5. The AI concierge
The concierge (Mira) is an AI system, not a person. Its answers are general information about selling a property, may contain mistakes, and are not legal, tax, financial or real estate advice. It can't make offers, sign anything or confirm appointments on its own. Please don't share Social Security numbers, bank or card details or passwords in chat. Our Privacy Policy explains how conversations are handled.
6. Your responsibilities
When you use the Services, you agree to give accurate information, to ask about a property only if you own it, are authorized by the owner, or are exploring a sale with the owner's knowledge, and not to use the Services to harass anyone, to look up owners for unrelated purposes, to scrape or automate requests, to get around security checks or limits, or to break the law. We may refuse or limit access to protect the Services and other people.
7. Your account
You're responsible for keeping access to your email secure, because sign-in codes are sent there. Tell us at info@prominentcashoffer.com if you think someone else has accessed your account. Your account shows the status of your request, messages and documents; the signed purchase agreement and closing documents are the official record.
8. Calls and text messages
When you send an offer request, request or schedule a call, or use your account, you agree that Prominent may contact you about that request by phone call, text message and email at the number and email you provided, including with automated technology. Messages are about your property, offer, call and closing; Prominent doesn't send marketing messages to sellers.

You confirm that the phone number you give us is yours or that you're authorized to receive messages at it. If your number changes or you give it up, please tell us.
9. Our content and your content
The Services, including the site design, text, maps, software and the Prominent name and marks, belong to Prominent or its licensors, and you may not copy, scrape or reuse them except to use the Services as intended. When you send us information, such as property details, photos, messages or corrections, you give us permission to use it to respond to you, evaluate the property and provide the Services, as described in our Privacy Policy.
10. Other services
The Services rely on providers such as Cloudflare, Google Maps Platform and Anthropic, and may link to other websites. We aren't responsible for other websites, and providers' services are subject to their own terms.
11. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we don't promise that the Services will be uninterrupted or error-free. Nothing on the Services is legal, tax, financial or real estate advice.
12. Limitation of liability
To the fullest extent the law allows, Prominent and its owners, employees and providers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Services, and our total liability for any claim about the Services is limited to one hundred U.S. dollars ($100). This section doesn't limit liability that can't be limited by law, and it doesn't change the terms of any signed purchase agreement, which governs the sale itself.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where the law of the state where you live or where the property is located must apply. Before bringing a claim, please email info@prominentcashoffer.com so we can try to resolve it informally. Either of us may bring a claim in small-claims court where it qualifies. A purchase agreement's own terms on law and disputes control for that sale.
14. Changes and contact
We may update these Terms. If a change is material, we'll update the effective date and give any notice the law requires; continuing to use the Services after a change means you accept it. If any part of these Terms is unenforceable, the rest still applies. Questions: info@prominentcashoffer.com. Prominent Cash Offer, LLC, a Delaware limited liability company.
